Please read these Terms of Service carefully before using the https://www.dds-cupcakes.com website (the “Service”) operated by DD’s Cupcakes (“us,” “we,” or “our”), and purchasing any of our fresh or online products.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

All products and Services including fresh products, online postal products, 1-2-1 in person classes, online classes and downloadable PDFs are subject to the following terms.

​

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

​

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

The service may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

​

Payments

For all fresh products ordered for collection over £50, a non-refundable 50% booking deposit is required upon ordering, to secure your order. The remaining balance is then due 1 week prior to collection.

​

If your collection date is within 4 weeks of your enquiry or less than £50, full payment is required upon booking.

For weddings, a non-refundable booking deposit of £50.00 will secure your order, with the remaining balance due no later than 4 weeks prior to the wedding date.

 

Weddings are on a collection only basis.

​

Provisional orders are kept for 24 hours only. If payment is not received within this time, you risk losing your slot in the diary. Please contact us to ensure your slot is still available before sending funds.

​

Please note that your order is NOT confirmed in the diary until your booking deposit has been received.

​

Payments accepted are bank transfer (preferable) or PayPal. All online orders are paid via credit/debit card and are non-refundable.

​

Cancellations

If you wish to cancel your order, please contact DD’s Cupcakes as soon as possible.

​

Due to our products being bespoke and made to order, any payments already made for cancelled orders are NON-REFUNDABLE.

​

In the unlikely event that we need to cancel an order due to circumstances beyond our control or ill health, we will give you as much notice as possible, and a full refund of any payment/s made to us will be given.

​

All online courses cannot be cancelled or refunded as they are instant access materials.

​

Allergens and Dietary Requirements

Our products contain: Gluten (Wheat), Milk, Eggs, Soya and depending on the flavour can contain Nuts and Peanuts. If buttercream other than natural is requested, food colourings will be used. Please note, some E numbers can have an adverse effect on children’s attention and activity. If you require specific information regarding food colourants, please do not hesitate to contact us.

We do accommodate dietary requirement bakes and can supply Gluten Friendly, Dairy/Soya Friendly, and Vegan alternatives upon request. All dietary requirements must be made known to DD’s Cupcakes during your initial enquiry.

​

Products baked in DD’s Cupcakes kitchen are NOT suitable for people with NUT allergies and may not be suitable for certain other allergies.

​

All products are made in a kitchen that handles Celery, cereals containing Gluten, Crustaceans, Eggs, Fish, Lupin, Milk, Molluscs, Mustard, Peanuts, Sesame, Soybeans, Sulphur Dioxide and Sulphites and Tree Nuts. We also handle Citrus and Strawberries. Therefore, we cannot guarantee a 100% allergen free environment.

Product Designs

To create your bespoke order DD’s Cupcakes will use images supplied to us as ideas & inspiration only. We do not copy work from other bakers.

​

Slight variations in the colour and overall look of the cake/cupcakes/toppers may occur as all items are hand crafted and made to order.

​

You may change the size of your order or design of your cake after the booking has been made; however, at least 3 weeks’ notice is required for celebration cakes, and 4 weeks for wedding cakes.

​

A change in the design, size or flavour of your cake/cupcakes may influence the total cost, either up or down. This will be discussed at the point of change.

​

Collections

All orders are on a COLLECTION ONLY basis. Collection is from my home studio based in Paignton, Devon.

For bespoke orders, a suitable collection time for both parties will be arranged upon booking. For seasonal/peak orders such as Mother’s Day/Christmas, specific collection slots will be provided.

​

You agree to collect your order within the specified slot. DD’s Cupcakes cannot guarantee availability outside of the specified collection time. If you miss your collection slot, you will be required to return at another time that is convenient to DD’s Cupcakes.

​

Once products have left the premises, DD’s Cupcakes cannot be held responsible for any damage or issue that may occur. Please ensure you adhere to any cake care guidelines provided to you.

​

Any repair work that may be required due to poor handling on your part, will require the appropriate fees, and will only be undertaken if DD’s Cupcakes has suitable availability. The cake will need to be returned to our studio and collected again after the repair work has been finished.

​

Non-Edible Items

Some of our cakes/cupcakes may have non-edible parts such as ribbons, toppers, flowers, support dowels etc. It is your responsibility to ensure these items are removed before cutting and consuming the products.

​

If flowers or other non-food items are to be added to the cake/cupcakes after collection, you are fully aware that there may be particles such as pesticides & dirt on them that are unsuitable for consumption. It is solely your responsibility to ensure the items are made food safe and suitable to be inserted into the cake/cupcakes.

​

Storage, Shelf Life, Transportation

All our products are baked from scratch to order and decorated as close to your collection date as possible, therefore they do not contain any additives or preservatives.

​

Our cupcakes are at their best consumed within 24 hours of the collection date but can still be enjoyed for up to 2-3 days.

​

Store your cupcakes in the packaging they have been collected in, in a cool dry environment away from any direct heat or sunlight. Do not refrigerate, as this can dry out the sponge.

​

Our cakes are at their best consumed within 24-48hours of the collection date but do have a shelf life of 4-5 days uncut, or 3-4 days once cut, if stored correctly.

​

You will be given care guidelines specific to your product upon ordering or collection. As a general guide we do suggest the following:

• Buttercream finished cakes to be refrigerated after collection, until 1-2 hours before cutting and eating, especially in hot weather

• Chocolate ganache finished cakes to be stored above in hot weather, or can be kept in its box in a cool and dry room away from direct sunlight or heat sources such as radiators out of the summer months

• ​

Once our cakes have been cut, we recommend you individually portion, wrap in clingfilm and refrigerate for the optimum shelf life. Just allow each portion to come to room temperature before eating.

​

Our brownies/blondies have a long shelf life of 10-14 days but are best consumed within 5-7 days after collection/postage. They are best kept refrigerated, and to ensure the longest shelf life keep in an airtight container or individually wrap in cling film.

​

If travelling with any of our products after you have collected from our studio, we recommend refrigerating them until the point of your travel.

​

All orders need to be kept flat at all times and are best placed into the passenger footwell or the boot (as long as the box cannot move around), and out of direct sunlight, during transportation. Having your car aircon on prior to and after collection is also recommended.

​

All our products are suitable for freezing and keep well for up to 3 months. Just ensure the products are individually portioned and well wrapped to eliminate the chance of freezer burn. Allow to return to room temperature before eating.

​

DD’s Cupcakes cannot guarantee the quality of the product if consumed after the time frames stated above, or if products have been incorrectly stored.

​

Returns and Damages

In the unlikely event you are not satisfied with the design of your cake/cupcakes you must make it known to us upon collection. If you leave with your order, you have consented it meets your requirements.

​

If an issue does arise with your cake/cupcakes a minimum of 90% of your order must be returned immediately so DD’s Cupcakes can fully examine the product for quality purposes and determine the issue, if apparent.

​

If DD’s Cupcakes agrees there is an issue with your order, an email will be sent detailing any action/refund if deemed necessary.

​

NO refunds will be given on the account of personal taste/preference.

​

DD’s Cupcakes decision is final.

​

DD’s Cupcakes cannot be held responsible for any damage caused to the cake/cupcakes once it has left the premises.

​

Postal Orders

All postal orders are via our online store at www.dds-cupcakes.com/shop when products are available.

Payment is by debit/credit card.

Orders are posted using Royal Mail 1st Class delivery unless otherwise stated or agreed upon booking. Please allow up to 5 business days for delivery.

​

Orders are dispatched on the day specified in the shop post, and to the address provided. DD’s Cupcakes cannot be held responsible for any error with the delivery address, if not supplied appropriately upon ordering.

​

Once the product has left DD’s Cupcakes premises it is then the responsibility of Royal Mail/Courier to deliver in a timely manner. DD’s Cupcakes cannot be held responsible for a delay in delivery once the package is with Royal Mail/Courier.

​

If the product arrives damaged, DD’s Cupcakes must be informed immediately by email with photographic evidence of the issue. DD’s Cupcakes will then suggest a solution to the issue if deemed necessary.

Intellectual Property
The Site and www.dds-cupcakes.com and all the materials available on the Site and www.dds-cupcakes.com are the property of us and are protected by copyright, trademark, other intellectual property laws, and all other applicable laws.

​

The Site is provided solely for your personal non-commercial use. You may not use the Site, or the materials available on the Site, in a manner that constitutes an infringement of our rights or that has not been authorised by us. Unless explicitly authorised by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Site.

All photos taken by DD’s Cupcakes of your cake/cupcakes etc belong to and are copyrighted to DD’s Cupcakes.

The photos of your cake/cupcakes may appear on Facebook, Twitter, Instagram, and DD’s Cupcakes website, but are not limited to just these.

​

The photos of your cake/cupcakes may be used in further publications/advertising either by DD’s Cupcakes or by other businesses such as magazines, websites etc upon permission from DD's Cupcakes.

​

Communications

By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Website Accounts

In order to purchase any of the Services on-line you must register for an account with us via the Website.  If you already have an account with us, you can log into your account using your username and password. You will need to note both for future log ins.

​

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

​

It is solely your responsibility for maintaining the confidentiality of your account and password, including, but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any, and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, remove, or edit content, or cancel orders at our sole discretion.

​

Online Courses

All online courses and downloadable PDFs are in English only and courses are without subtitles.

​

All online courses and downloadable PDFs are instant access; therefore, they are exempt from the 14-day cooling off period and are NON-REFUNDABLE.

​

It is your responsibility to ensure you have the correct services for viewing our products at the time of purchase. Unfortunately, DD’s Cupcakes is unable assist with technical help regarding this.

​

As part of the order process, you are required to set up an account. This is where you will access the course/s you have purchased. It is your responsibility to note your username and password, for future logins. Courses can be found in the ‘MY PROGRAMS’ section on your profile.

​

Once purchased, courses are yours to keep, and can be viewed as often as required via your account as stated above, for a period of 2 years. If we remove a course from the site, you will still have access for 2 years from the purchase date.

​

If your account remains inactive for more than 2 years, DD’s Cupcakes reserves the right to remove your account.

All courses/products are in £ Sterling, further fees such as taxes, import duty etc may be incurred if purchasing from outside of the UK. DD’s Cupcakes is not liable for such charges, please check with the relevant companies prior to ordering.

All DD’s Cupcakes online courses and downloadable PDFs are for individual personal use only. Unless explicitly authorised by DD’s Cupcakes, you may NOT modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any of the courses/documents purchased. Any abuse of use; or infringement of copyright, will result in the appropriate action being taken.

The nature of the Services provided by us means that we will obtain, use, and disclose (together "Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. By purchasing the Services, you agree to this Use.

When you create an account with us you will need to provide certain Data such as your contact details and demographic information. We will store this Data and use it to send your products, contact you, provide you with details of the Services you have purchased and otherwise. We will not pass your details onto any third party unless required to complete your order.

To enable us to monitor and improve our Services, we gather certain aggregated information about you, including details of your operating system, browser version, domain name and IP address, the URL you came from and go to and the parts of the Website you visit.

Our products may link to third party websites, and we are not responsible for their data policies or procedures or their content.

​

DD’s Cupcakes endeavour to take all reasonable steps to protect your personal Data but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting on-line over the internet and will not hold us responsible for any breach of security.

We will only use your Personal Data in accordance with the Data Protection Act 1998.

Force Majeure

DD’s Cupcakes shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the family, illness/ill health, Government edict or regulation.

 

This Agreement is subject to English law and the parties submit to the exclusive jurisdiction of the English courts in connection with any dispute hereunder.
